As long as the income is being paid into an account for your mother’s benefit, then yes. Either selling or renting a former home is a standard way of raising funds for care.

If you suspect that the LPA is diverting the rental income for their own benefit, then this would be illegal and you can raise a formal complaint with the body which oversees the management for LPAs.

Mom's savings have dropped below the threshold level,when inquiring about selling her property we have discovered that although the property is in her name she never made any mortgage payments, therefore the guarantor made all the payments, he now says the property is his as he payed for it, this allowed him to obtain the property at approximately 60% price reduction under the right to buy scheme, is this fraudulent?

I don't think he is correct, he used a property, or a special savings account, as security and paid mortgage on behalf of your mother if she defaulted.

Get a copy of the guarantor mortgage agreement and take legal advice.

Check if the "Right to Buy" scheme applies to this property.
