Hi my mum is in hospital getting ready to move into a care home she is OK the now to make her own decisions but I have poa if she can't make decisions on her own and her social workers have put a block on her bank account without any permission is this legal

Have you asked why social services have put a block on your mum`s account.

If you have a PoA I wouldn`t think they would be able to.

The Helpline might be able to answer your question.

Hello @Gazzaboy and welcome from me too to this friendly and supportive forum.

I would agree with what @Grannie G has said. If you have POA for your Mum, I can't think SS would have any authority to do what they've done, so please do contact the helpline.

I would think that the hospital SW has decided that your mum now lacks capacity. If banks get any wind that someone has dementia and/or they have lost capacity, the bank themselves tends to freeze that account.
I think its probably time for you to register the POA at her bank - especially as she is moving into a care home.

Isn't there 2 kinds of poa, Health & Welfare and a separate financial one too?
If you only have a h&w poa then finance isn't covered.

Agree, doesn't exonerate social workers from informing bank of her incapacity.
