How do I help mom sort out doing a will .Mom has fluctuating capacity . Any one have any advise and the legal side of things to make sure it done correctly .thankyou . Nothing like a house to leave I will .As mum lives in council house . .

If she is happy with how her estate will be distributed under https://www.gov.uk/inherits-someone-dies-without-will she need not make a will , somebody could apply for letters of administration https://www.gov.uk/applying-for-probate/if-theres-not-a-will

There may not be a need to obtain letters of administration and apply for probate as most banks will release reasonably large sums on sight of a death certificate, probably asking for an indemnity to be signed. Most insurance companies will demand probate.
