Need advice

my mother in law has severe vascular dementia I ended up giving my full time job up and working part time to look after her I did get adult social services in but they said they couldn't help ???? Anyway I had to call an ambulance last week she was so ill since then the hospital have said there is no way she can return home she needs a care home ( to be honest I'm relieved ) I really did struggle ! My husband and I have her bank card and have been paying bills getting shopping sorting things out etc... Our name is not on her bank and really she has no capacity to put it on if she goes into a home do we have to get power of atourney or will they just take over the account etc .. She has around 10.000 pound .

If your mil no longer has capacity (and it sounds as if she doesn't) the only option is to apply to the court of protection for deputyship. I have to warn you you should not be operating her bank account under these circumstances.

Having said that, if this bank account is her only asset, then it's below the lower limit for funding so it will not need to be touched. You could apply to become her appointee with the dwp which is fairly fast. This would allow you to manage any state pension/benefits she receives, although the vast majority of it will go to the local authority to partially pay her care home bill. It won't help with any private pension she may have however.

Does she have any other assets (home for example)?

I hope Adult Services are now more helpful with finding a placement for your MIL and she gets the support she needs
from what you write she will be funded by the Local Authority (if she has no other assets at all), so they will do a financial assessment, and probably take her income and leave her with about £25 a week for her personal expenses
as jenniferpa writes, if your MIL no longer has capacity enough to agree to someone arranging POAs, your husband would be wise to contact the OPG about becoming her Deputy so that he has the legal authority to deal with her finances
