Getting a PA14 signed

My sister who has POA for my mum is trying to apply for probate for my dad's will in which mum was named as executor so we need a PA14 form signed to go with the application. Mum is in a care home with Alzheimer's. I assumed it would be straight forward to ask her GP to complete the form but they have point blank refused and I don't really know where to go from here. Has anyone else encountered this or have any advice?

Only the medical professionals listed here can complete this form:

  • a registered medical practitioner (for example the patient’s GP)
  • a registered psychiatrist
  • a registered approved mental health professional
  • a registered social worker
  • a registered psychologist
  • a state registered nurse
  • a state registered mental nurse
  • a registered occupational therapist

Thanks nitram. My mum doesn't have any of those involved in her regular care but I'm going to talk to the care home again. There is a Frailty nurse who comes in to do regular reviews so that might be a possibility. I just can't understand why the GP won't help.

I suspect that many clinicians steer clear of signing legal certificate of incapacity worried that there could be a legal challenge.
Mum is in a care home specialising in dementia. All the residents are automatically registered with this GP and they do a weekly surgery at the home.

The GP could in the past have unintendedly become involved in a contentious legal case and decided 'never again'.

It is becoming increasingly hard to get someone to sign an official form stating mental incapacity. Many people have gone down the route of a private Social Worker (use google to find one in your area)
