Dads 2nd house

My sister has lived in my dads 2nd house for over 20 years in line with my fathers wishes.

We had to sell his 1st home to pay care home fees over last 5 years.

Has anyone got advice on whether we can avoid selling dads 2nd house to pay for care home fees? Or where to go for legal advice on this?

Hi @adhallai welcome to the forum.

I suspect the answer to your question may be no - unless your sister is over 60.

I would avoid taking the advice of any solicitor who tells you that putting the house in a trust will make it impossible for the local authority to sell as, while that may be true on paper, the LA will simply treat your dad as though he has the money and refuse to pay his fees.

If your sister is under 60 you can ask the LA for a discretionary disregard of the property but they don’t have to give you one.
