Care fees... Who pays?

My mother has been in a nursing home since mar 17..she awaiting a DST. It was done in Mar 18 and was denied chc funding. We are appealing amd a local resolution meeting is Nov. Up to now the LA have been paying care fees. They recently wrote to say they are no longer paying and mum should pay them back. We have had a private DST carriedcout and employed a solicitor who is confident we should get CHC. As we are in process of defining who is responsible, is mum legally responsible at this time to pay?

Solicitors are always confident they will win. In reality CHC is incredibly hard to get so don't set too many hopes on it, and I hope the solicitor's fees aren't eye-watering.

Is your Mum self-funding? Then she is responsible for the fees but I would have thought that they should wait for the appeal. I don't understand that she is awaiting DST because that is the same tool you have to fill into determine CHC as well as nursing cost contributions.

Does your mother own a property?
If so she may have benefited from a 12 week disregard which has now expired.
