Capacity to Sign a Document

My mum has some memory problems but no diagnosis and is currently going through a 'neglect' case via solicitors with the NHS and am concerned that if a settlement is agreed they may consider she doesn't have capacity to sign a legal document. What is my position as I don't have a POA in place'

If the solicitors are representing your mum then they must consider she has capacity to enter into a legal case, I would talk to them and also talk to them about getting the power of attorney documents sorted out and registered. I'm not a legal expert it;s just an opinion. Good luck.

Good advice from Sister Millicent. Would certainly look at getting POA'S done not only for property and financial but welfare too as this is a claim on the NHS.
