What do we do about mums house

Mum had a fire due to forgetting about a small electric fire in lounge, she was taken to hospital for smoke inhalation , I phoned adult social services (who knew mum had vascular dementia 9 months ago,but said she could cope at home ) I said we did not have room at our house and they would need to find respite care, they placed her in dementia home , then 4weeks later did another assessment and said she was unable to look after herself , we are now coming to the end of 12 week disregard and have a bill for 850.00 pw , we are unable to put house on market as still being repaired after fire, what do you advise, we have just found 2 x charges on house but her financial ass says we have to sell house to fund care, surely if sent to care home from hospital she shouldn't have to pay?

If her needs were social and not medical her stay would not be free, she would either be self funding or her fees paid by the LA subject to the normal financial assessment etc.
An exception is a possible maximum of 6 weeks reablement period.

Hi Badger1966, welcome and sorry to hear about your Mum,

Unfortunately the way the system works Dementia on its own is not seen as a medical need and therefore as your Mom owns her own house or has savings then she has to pay herself.:mad:

When the Financial Assessment was undertaken were the Local Authority aware of the 2 x charges? Depending on what the charges are for the LA may not be able to force a sale, just yet anyway. If they do not know you need to contact them today.

However, just say the house is not included. The LA will only help fund a certain amount towards the care bill. Each area differs and mine is £410/week. Included in that are any pensions your Mom receives. So there is still a shortfall in the weekly cost of over £400. Someone other than your Mum will have to pay that for her to remain in the current home. If no relative or friend can pay you may have to look into moving her somewhere cheaper.:(

What Pete R says is right, unless there is no suitable home which can meet all your mum's needs which charges no more than the LA's going rate. The LA has to pay the full amount if there is no home available at their usual rate.
