section 3 and 117

hi every one I need some advice, my husband is a patient in hospital under section 3 of the mental health act and it has been decided that he will not come home because of his and others safty, he went to one home but was sent back to hospital because the could not cope with him, so they say he needs e.m.i. nursing a home has been found but it is expencive and they now say they cannot fully fund him to level he needs of care any help and advice would be welcome . thank you all shirley

The LA /NHS will just have to pay.

Be careful because the Care Act now allows LAs to charge a top up for a S117 placement if, and only if, the person has a preference for a particular home not suggested by the LA.

Don't sign anything.
