Just found this via a link posted on the Parkinson's UK site. The link actually pointed to a video that's no longer available but then I found this which I suspect is an updated version:

I'm trying to prepare for a CHC meeting in a couple of weeks and although I've only watched a bit so far it looks as though it could be very useful to anyone wanting to find out more about the process.

About 14 mins in there's an interesting explanation as to why the sale of council houses led to many more people having to pay for their own care.

This is fascinating. It explains how we got to where we are today in terms of the health/social care divide. I've got to take a break now and check on Sue.

Thanks for this. Haven't had a chance to watch it yet but look forward to it.

I know of Luke Clements, and have read his damning criticism of the DST - from a lawyer's point of view - and how the bar to obtaining CHC is set higher than it should be.

Hopefully you will get plenty of information which will be useful for your forthcoming CHC meeting, and others in the same situation can benefit from it too. Thanks again.

O.K. I thought I could only tackle this in bite-sized chunks but it's actually so good that I couldn't stop. Not only very, very relevant to the issues we are interested in but a masterclass in teaching. I'd urge anyone who has an interest in CHC to view it. He has a very clear way of explaining things and I now feel pretty clued-up.

The most important point he makes is that (this may sound obvious) the law trumps guidance every time. And the law that exists at the moment is much more favourable to those of us seeking CHC funding than we might have been led to believe.

On that encouraging note, I'm off to chill out with 'Nashville'.

Splendid, informative video, Stanley but I disagree about the timing of the explanation, I think it begins at 10 mins in.

The NHS Continuing Health Care clinic was set up in 2007 in partnership with Cardiff University Professor Luke Clements and Hugh James Solicitors, as an extension of the Cardiff Law School Pro Bono Scheme.

It's nice to see Luke Clements name popping up here again. He knows his stuff.
He works in close partnership with the solicitors that I used.
Lisa Morgan of said solicitors, is the editor of booklet below.

Factors which cannot be used to refuse CHC

People who read my main thread about Sue will know that it's almost certain that she will get CHC funding. It just has to be confirmed by the Commissioning Group.

I want, over time, to add some things to this thread which might help other people deal with this complex and for some people treacherous process.

Luke Clements lists these factors which cannot be used to refuse CHC funding:

* The setting of the care (home/hospital/care home etc)

* The ability of the care provider to manage the care

* The use or not of NHS staff to provide the care

* The need for/presence of specialist staff in the delivery

* The fact that the needs are already well-managed

* The existence of other NHS-funded care

* Or ANY input-related (rather than needs-related) rationale


I hope other people will feel free to contribute their experiences.
