If someone has lost capacity what happens then?? Who can make decisions fir health and welfare??

Essentially if the person has lost mental capacity to make a specific decision then it should always be made in the person's 'best interest'. Depending on what the decision is it may be made following discussion between a number of individuals such as medical staff or social workers, including input from family/carers. I never had H&W POA for mum, but it didnt seem to cause any problems. Medical staff always talked to me and took my views into account, and I was always happy with what was suggested.
If there are disagreements about treatment, where they live etc, it might need the Court of Protection to make a judgement, but I never had to go along that route.
