Local Authority will not pay the extra for Dad's specialist younger ppl care home

Hi everyone,

Dad was recently moved from his own home into a care home at short notice due to a sudden decline in his condition. He was moved by one local authority, into a care home in another local authority's area. Cut a long story short, the authority that moved him expected they would be the ones to complete the financial assessment so they placed him in an expensive speciality home for younger people with dementia (he's 61) safe in the knowledge that they, the local authority, would pay the extra fees (it's about £590/wk compared to about £400/wk elsewhere in the region for normal homes). However, they didn't ask us about his financial situation immediately before moving him (they had assessed him a while ago and assumed he would now have less savings than before - little did they know Dad is a tightwad and had barely spent a penny) and Dad actually had more money than they thought and is self-funding atm (tho not for long), meaning the other local authority is responsible for doing the assessment. And yep, you guessed it, the other authority do NOT want to pay the extra fees and are insisting we move him to somewhere full of old people and we are utterly gutted. It is a brilliant home ( that has been on the telly a few times because of it's unusual approach to managing dementia patients without using antipsychotics, and the ONLY specialist CH in the area [country?] for younger people) and he is, despite all expectations, HAPPY there and we do NOT want to move him.

What are our rights? If we can demonstrate that nowhere else is suitable by ringing around and getting in writing that a few places will not accept him due to his age (which is true - SO many places will not take people under 65, never mind someone under 65 who has thrown punches at other residents before and has been medicated for paranoia for a long time and won't sleep and never stops pacing and has escaped from his current CH before by scaling a 6-ft wall!!). Is there an appeal procedure? The SW never told us anything as she went on holiday immediately after making the decision and is now "in training" all week :rolleyes:. I work full time and have been putting in 50 hours/wk recently due to having a lot of work on so I'm really struggling here to find the time to find out what to do!

SW said Dad would be able to pay the difference from his savings until they ran out, which would be about 2.5 yrs - if this is our only option it is what we will be doing without a doubt. Can't think of a better way to spend my inheritance. That's how strongly we feel that there is nowhere else he should be than the expensive home he is already in! Why don't the local authority see it that way? :(
