Has anyone had an experience in appealing against a deprivation of liberty order?
I understand its a Court of Protection matter. Besides costs, how long does it take for a judgment to be made?

Sorry I can't help you as have no experience with this.
I hope you get this sorted to your satisfaction quickly.
Wanted to give your post a bump to the top as We do have people on here who may be able to help, so do keep checking back here.

I was wondering if the CAB would be able to help even if they can only put you in contact with Solicitors who have experience with this .

Hi In A Whirl

Is it possible you can give us some more details? Has the DOL been issued in a CH or Mental Health Institution?

Take care

Is the appeal against the original decision or do you think circumstances have changed?

The aged parent is in a care home & subject to 24 hours supervision. The appeal will be against a DoLS order that has been put into place because of the Cheshire West decision last year. Aged parent does not want to be in a care home. The change in circumstances is a gradual decline due to lack of mental stimulation & reduction in mobility.

>>>THIS DOCUMENT<<< gives a good overview of the implications of the Cheshire West judgement.

The links at the end are especially useful.

You could study all these links and if you still think the DOLS and the way it is being used is not appropriate ask for a review reinforcing your argument with information from the links.

Have you asked the solicitor about costs?
(S)he should be able to tell you any court costs that could be involved depending on how the case progresses.
