I heard a while ago that social services have refused funding for my husband who was sectioned before Christmas under section3. (Because of this he is entitled to Section 117 aftercare) I am now expecting to hear from health tomorrrow, who I am hoping will agree the funding. If not, another application has to be made for shared funding. Meanwhile he is still in hospital. The staff do their best considering the resources available but he needs proper nursing care and I am desperate to have him move to the home where he has a room allocated. Is anyone else frustrated by the system? I feel so helpless and sometimes feel that I should give it another try and have him home again. I know this is not a realistic prospect because of his agression and specialist care needs but oh how I wish things were different,

Hi Joy,

Dont let the Social Services grind you down, dont let them bully you or throw a load of legal jargon at you as they will - believe me I have been there, as I am sure many others have.

The one and best piece of advice that I can give, is speak to the Alzheimers legal helpline they are invaluable, understanding, patient and in my mums case have been 100% right each time, absoulty priceless...........

I have done an interview with Womans Own Magazine, [and at the moment awaiting a publication date] and to try to express my gratitude to the Alzheimers Society the entire fee will be donated to them.

Hi Joy,

In case you need some facts to support your husband's situation:

Under section 117 MHA 1983, there is a duty placed on local authorities to provide after care services free of charge until the patient no longer needs them. This is for patients discharged from hospital who have been detained under section 3 MHA 1983.
The Local Government Ombudsmen have issued a special report which details new guidance on the funding of aftercare under section 117 of the Mental Health Act 1983 which reiterates that under section 117 MHA 1983, there is a duty placed on local authorities to provide after care services free of charge until the patient no longer needs them.
The report states that a significant number of social services authorities have broken the law by incorrectly charging mental health sufferers whom have been discharged from compulsory detention in hospital for aftercare services - in particular residential accommodation.

Thanks everyone for your advice. I am still waiting on decision from health regarding funding ( they sat today) so hopefully good news tomorrow. If no luck there I will certainly be contacting social services again with the information you have given me. Thanks again

Just to let you all know we received funding from health and my husband is moving from hospital to a nursing home over Easter. It will be a difficult time for him to adjust but I know he will eventually be more settled so am looking forward to getting the move over with. Also received enduring power of attorney through. I didn't use solicitors and downloaded the forms from the internet. Any one need any advice on this I may be able to help.
