Discharge help urgently needed

Hi My dad has stage 6 vascular dementia and is currently in hospital following a fall. Hospital are now saying he is medically fit and therefore he needs to be discharged. As there is no POA in place they have carried out a best interests assessment and are sectioning him under section 2 of the MH Act into a nursing home as he is very underweight and undernourished. We have no objection to this. However, the care home they are discharging him into has extremely poor CQC ratings - including comments regarding patients' nutritional needs not being met. The hospital are telling us that under COVID regulations they have a 'no choice' policy in place, but how can I prevent them sending dad into a care home that has needs improvement/inadequate ratings across the board other than threatening them with legal action if they do?

Do you have a better one in mind which has a vacancy for him? If you can present them with an alternative there is a good chance they will go for that to keep the family happy and solve their discharge problem.
