Care Home Fees Question

Hi there,
Does anyone know what happens next. Mum has gone into a care home, the Financial Assessment has been finalized. Mum's bills from the CH will be paid from her bank account, which we manage. Does the LA take over Mums bank account, or do we continue to manage the payments for the CH from it? My sibling and I have joint POA and we also own Mums house. We need to go through Mum's things and eventually sell the house. But have not been told anything.

No, the LA doesn't take over the bank account. Is your mum a self-funder - does she have savings/assets over £24,500 (not including the house)? If so, then you and your sibling are responsible for paying the CH bills. The process is different for those who are not self-funding so if you confirm the position we can better answer your query.

Hello @Louise7, thanks for your reply. The LA have stated in the Financial Assessment how much a week Mum must pay towards her CH fees. Mums only income is her pension and LA have assessed her to pay all her income from them (bar a small sum of what appears to be pocket money) towards her care. We assume due to her low savings the LA must be paying the rest. Her savings are well under that threshold. Mum has no property as such, we own the house Mums lived in for a long time. Just personal possessions really. Its now clear Mum wont be coming back home, so we need to think about selling the house (its in our names). LA haven't clarified much, it arrived in the post

You really need to be aware that the LA may challenge the ownership of the house. Moving the ownership to you are your siblings can be questionable if carried out to avoid payment of future care fees. Timing and method this was carried out should be checked to answer challenges if made by LA

If the house is owned by you why do you have to sell it?
If your Mum has no assets, as you so rightly say, all her income apart from “pocket money” goes towards the Care Home fees and the LA pays the rest.

Presumably if the Financial Assessment has already been done, the status of the property has been taken into account?

Yes we are aware the LA may challenge the ownership. We are expecting that. That’s fine they can request the solicitors records from back then. We will have to wait and see.

Seeing mum deteriorate so fast after being admitted to the care home during covid is devastating for us. Mum just looks totally vacant, not a flicker of life, can’t speak, can’t walk, doesn’t know who we are, zombified on drugs, struggling to stay awake. Such a horrible illness, we are shocked.

Hi Mrs V - have you looked into Continuing Health Care funding? - from what you have said your mother might pass the initial checklist which could lead to her funding being paid for by NHS. I have attached a link and ( if you look at the starred domains - see note 15) she might qualify to go to the next assessment stage. Thank you so much. No we hadn’t even thought about it, as we have heard from others that this is something hardly anyone qualifies for, and the LA keep it quiet. Thank you we will look into it
