I don't think I explained properly. As long as your father is living in the marital home at the time of his wife's death, the property is disregarded completely. No ifs, ands, or buts. The other things are "or" statements. So, as an example, if you were living in the house, were over 60 and your father subsequently went into a home (before or after his wife's death) the house would still be disregarded.

So a problem would arise if both mum and dad went into a care home at the same time?
