If there is anyone else who has family in the Devon Area that has been reassessed should also get in touch with this paper, here is my Mum's story they have run today..........

Jackie just read the article, it is a national disgrace that we as a county cannot look after our own people who are in need of nursing.

Gordon Brown and his predecessor Tony Blair who stood on the steps of Downing St in 1997 saying "HE DIDN'T WANT A COUNTRY WHERE THE ELDERLY ARE FORCED TO SELL THEIR HOUSES TO PAY FOR CARE" and here we are today and nothing has changed. People are still paying for their care and charges being made against their homes. Absolute Disgrace.

I know, what the paper failed to mention is that the NHS/Social Services have already taken all of her personal finances to pay for her care in the first few years :mad:

I also find it disgraceful and shocking that the assessment was done behind your back, good that you went public about it .

So what would have happen if no one could of funded your mother nursing care?

Jackie the article says the PCT will carry out another assessment and fund until this is done. They have to notify you of the appeal process (if needed I hope this isn't the case) they then have to continue funding until your case reaches an Independent Review Panel.

I would consider applying for a Retrospective Review for previous years CHC when she was self funding. www.continuingcarecampaign.co.uk is worth a look. If you are in the process of claiming CHC you are then able to go through the appeals process therefore slowing down the present process. There are solicitors who specialise in CHC and will handle cases on a no win no fee basis. The name of the solicitor is on the continuingcarecampaign website.

They have confirmed they are funding while they are reviewing and this was already the case anyway while the South West NHS are investigating the PCT in Devon. Fingers crossed this wont happen as so far all the other cases the paper has highlighted have been overturned. :D

Just to let you know that I am still no further on my mums case and waiting to see the independant report that is meant to be published today.

The link for the continuing care campagin doesnt work :(

Was it some 23 recommendations in the summary? That has got to be good news ... but only if those recommendations are put into practice and then monitored. And from reading the whole of the Report, I get the feeling that they may well be.

Difficult to keep the momentum isnt it ? On top of all the emotion of losing someone you have juggle the administrators and maybe lose your home !

Re assessment is very difficult - on the one hand you want your relative to have a second chance to obtain funding but like you said in the article it also means that you have to admit that they are in decline.

I came out of a panel hearing recently, for my mum after reassessment- when they told me they unanimously agreed it was continuing care I wept, because it meant she was as bad as I knew she was but did not want to see it. Not the reaction they expected !

Thanks Maya, I have been going through this with my mum since at least 2000, and there are only a couple more declines she can make really and that is NIL by mouth and then the inevitable really. This is why I am so angry that the CC has been taken away, and looking at a copy of the health needs assessment and the decision support tool for the Continuing care that was done on mum back in early December last year only fuels my anger as to why it was taken away. :mad:

I am used to this fights and willing to fight all the way ......

Good luck Jackie , having funding withdrawn is worse that it not being agreed in the beginning ,implying the person has had a miraculous recovery .
Right now, Im ashamed to be a British tax payer.
