My Grandma is currently in a nursing home for dementia. My Grandpa passed away late December last year Grandma was nearing her threshold of £23000 and would have got local council funding. As she is not able to do any financial decisions we have applied for deputyship BUT until this is granted we have no access to her accounts. Would the council pay for her care in the meantime? They seem to not be willing to pay until the courts have granted the deputyship by which time the money left to her from her husband will not be sufficient to cover the cost of her care. Would we be liable for the shortcomings as a new claim will include any monies left to her and a new claim will only start from when the financial audit take place.

Im so sorry to hear about your Grandpa. You could contact SS financial department and ask them about this problem - Im sure it wont be the first time that they have come across it. You could also ask the Court of Protection to fast track the application. Sometimes they will grant an interim payment before deputyship is actually awarded.
