A few years ago before my husband was diagnosed with dementia we made mirror wills which involve an Assert Protection Trust. I'm now worried that this maybe wasn't the best thing to do. If be grateful for any advice.
I realise that if it wasn't a good idea I can't change his will now because he wouldn't understand why and wouldn't be happy about spending more money on more new wills, we have made several over the years when circumstances have changed, and I don't think he would be considered cogniscent. In view of this would it be possible to just change my will so that if I should die first the trust would be taken out of the equation. I guess unfortunately if he die first the trust will still exist but hopefully I will be able to deal with that and not have to leave it all to my daughter to deal with.
Also my husband and myself along with our daughter are executors of each others wills but my husband would not be able to deal with this now so I would like to take his name out of the equation.
We hold our property as tennants in common.
