Has anyone had to take Legal action against an Nhs service?

If so is there a specific organisation that caters for Carers?

Ive had 2 replies to my Complaint via "Pals" - both of them are similar in tone and address none of the issues i have with the service delivered - It has now gone to the Ombudsman but i am now lost in this process and am considering Legal action

Why does it have to be like this?

i Am "losing it" big time

There are many specialist lawyers out there who do a "no win no fee" case for you.
Most I understand do a free interview first to decide whether or not they think you have a case as if you don't there's no point in them taking your case on, this at least will give you some idea if the legal profession believes you have the makings of a case.
I guess negligence is the big one as they hold all the evidence it might be difficult to prove in a way.
Generally I'm against suing the NHS but where they have clearly failed in their duty of care to the detriment of someone's health, it sometimes is the only way to make things improve though.
Obviously I don't expect you to put all the circumstances on here so I suggest you get some outside advise that you do have a case.
The free interview and advise should come without you having to commit to anything so you could start there.

I have a ongoing complaint. Healthwatch are in my opinion useless. So are PALS but you have to go that route unless you are going directly to a lawyer. Mine is currently with the PHSO who are simply repeating the process that I went through with PALS - what a waste of time. Meanwhile people are dying....................what can I say about the state of the NHS in this country - too many agency nurses, not enough hands on knowledge and their grasp on dementia is NIL
Rant over - if I was doing it again I would go straight to a lawyer

I agree

You are urged to go the formal route and you know before starting that its a waste of time

Im in the hands of the Ombudsman and i still have very little faith

That people should go through life and end up in this mess is beyond depressing
