I am currently filling in some forms to send off to a solicitor who have been recommended to me from someone on here. Once they get all the info they decide if there is a chance of success or not.
That part is free so not a lot to lose.

could you possibly give the name of the solicitor as I have enquired with a few but they all charge fees of up to £1000 for just deciding if we have a case that might be successful. It ranges from 545 plus vat to £250 an hour and most reckon it will take 4 hours of their time. This is far too much for me spend
My Husband didn't pass the initial checklist for CHC-probably because the MHU mixed him up with another gentleman (both my Husband and the other patient was mentioned in the checklist.) Obviously I appealed However, a word of caution; when I was allowed to have another checklist completed it took me much more than 4 hours of work to prepare a case, and that was with the backing of a CH who kept exemplary records.

I just paid £822 for the preliminary phase with continuing healthcare company based in Birmingham.
I have experience of continuing health care panels as a doctor - be warned the assessment is often done by social workers who have no experience of medical illnesses or how these relate to day to day care and the panels are very variable. Lots of people who should have qualified for continuing health care never got told they were eligible or worse still were told only then for them not to be assessed properly.
A solicitor will ensure at least that the assessment is carried out properly and presented properly to the panel.

We didn't use a solicitor but paid for an advocate from a specialist company. MIL got CHC and it cost just over £1000.

Dad has not been assessed properly and is getting worse on a daily basis. The CHC assessor spoke as if from a pre ordained list as to what she should say. She was like a robot. Anything we questioned was quickly thrown out with curse answers to our argument. My problem is I don't know how to go about appealing. I know the procedure but I don't know how to write the letter. I know dad has multiple co-morbidities but I don't know how to express them and that is why I think I may need a solicitor.

They use trained medical nurses who are experienced in CHC funding assessments and will look through your fathers checklist, in fact they will give you good(free) advice over the phone or via a(free) questionnaire , they will let you know how to appeal and will act on your behalf and take you through the process. The firm also produce a lot of free booklets about the CHC funding process and how to go about it.

If you feel that you need the support from a solicitor to appeal a decision then they will help, it is not necessary to use a solicitor to appeal you can look at the NHS CHC Guidelines online (but they are a bit wordy !) or contact them direct, but if you feel you need a solicitors support then that is what you should do. It will put your mind at rest and be a lot less hassle! And these people deal with that sort of thing ALL the time!
